Privacy Policy

Jewel Heart Corp. respects our users and their privacy. The purpose of this Privacy Policy is to inform you about the following:

Scope
Our Privacy Policy covers all of jewelheart.org and related properties owned or controlled by Jewel Heart. Our Privacy Policy does not apply to entities not owned or controlled by us, such as third-party applications and/or other web sites. This Policy does not cover Jewel Heart’s presence on social media platforms such as, including but not limited to: Youtube, Facebook, Google+, Linkedin, Twitter, Tumblr, Pinterest, Flickr, Soundcloud, and on publishing platforms such as, including but not limited to: Issuu, Scribd, Medium on which we have established our own presence. In the context of those platforms, we are merely another user and the privacy policies as well as the terms and conditions of those platforms are applicable.

Information Covered
The Privacy Policy covers information users provide to us, including, but not limited to, name, email address, physical address, phone number, other personal information, content of messages and comments, and transactional information, including but not limited to, credit card and billing data. Information collected from users may include their site activity, access device, browser type, their location, IP address, pages visited, cookies, and other similar information. Sources for the information provided to us include, but not limited to, email signups and course registrations through our website or Zoom.

How Jewelheart.org Uses Information
We use the Information Covered to manage services provided by us or our licensees or affiliates, such as contacting users regarding programs and events via email with their consent. We do not share non-personally identifiable information, such as aggregated user statistics, with third parties. We keep such information for only as long as needed for business operations and legal compliance.

Google Analytics
We use Google Analytics’ to track website and webinar usage.

Opt-Out
You may opt out of the automated collection of information by third-party ad networks for the purpose of delivering advertisements tailored to your interests, by visiting the consumer opt-out page for the Self-Regulatory Principles for Online Behavioral Advertising at http://www.aboutads.info/choices/ and edit or opt-out your Google Display Network ads’ preferences at http://www.google.com/ads/preferences. Because those opt-out and preference control pages are specific to the individual browser used to visit it, and because that page is not operated by us, we are unable to perform the opt-outs on your behalf.

Cookies
Cookies are small pieces of information sent by a website to a user’s hard disk. Cookies cannot be used to run programs or deliver viruses to your computer. By continuing to visit our web and mobile sites, you agree to the placement of cookies on your device. If you choose not to accept our cookies, we cannot guarantee that your experience will be as fulfilling as it would otherwise be. We may also place cookies from third parties for functional and marketing purposes. The use of cookies is widespread and benefits the user.

Signing up for our email newsletters
We use third party platforms, Constant Contact and MailChimp, to manage our email distribution lists. If you choose to register for our email newsletters by clicking “Register” on our Website, you will be presented with a secured form in which you will be asked to provide your Personal Information, which includes your email address, and you will be asked to select your mailing preferences. Any information you submit through this secured form is provided directly by you to Constant Contact or MailChimp and is also subject to Constant Contact’s or MailChimp’s privacy policy. We have a data processing agreement in place with Constant Contact and MailChimp, as we are the controller of such Personal Information provided by you to Constant Contact or MailChimp and as we have the right to access such Personal Information and process the Personal Information for the purposes as set out below.

Making a donation
We use a third party, PayPal, to process online donations to Jewel Heart made electronically through our Website. If you choose to make a donation by clicking “Donate”, you will be transferred to PayPal’s secured form. Any information you submit via our Website through PayPal’s secured donations form is provided directly by you to PayPal and is subject to PayPal’s privacy policy. PayPal will provide us with certain information about you (including your name, billing address, email address, donation amount, whether the donation is made in honor of someone, and the reason for the donation if applicable, but not your credit card number) when you choose to make an online donation to Jewel Heart through the Website.

How Jewelheart.org Shares the Information Covered
Jewelheart.org may disclose information pursuant to subpoenas, court orders, or other requests (including criminal and civil matters) required from jurisdictions inside or outside of the United States where we have a good faith belief that the response is required under local laws of that jurisdiction, applies to users from that jurisdiction, and is consistent with generally accepted international standards. We may also share information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to protect ourselves and you from people violating our Terms of Service. This may include sharing information with other companies, lawyers, courts or other government entities.

How Jewelheart.org Protects the Information Covered
We take many steps to keep your information secure. All account information is stored on secured servers behind firewalls. Sensitive information (such as credit card numbers and passwords), is encrypted using secure socket layer technology (SSL). Despite our best efforts, there are risks inherent in sharing information. We cannot control actions of other users with whom you share your information. We cannot guarantee that only authorized persons will view your information. We cannot ensure that information you share will not become publicly available. We are not responsible for third party circumvention of privacy settings or security measures.

To further protect your information, you can reduce your risk by using security practices such as choosing a strong password, using different passwords for different services, and using up-to-date antivirus software.

We also respect minors’ privacy. Jewelheart.org is intended for adults. Children under age 13 are not permitted to join this site. We also recommend that minors 13 years of age or older ask their parents for permission before sending any information.

Changes to our Privacy Policy
Jewelheart.org reserves the right to change this Privacy Policy at any time without notice to you. Any changes will be effective immediately upon the posting of the revised Privacy Policy. Jewelheart.org will not, however, use your Personal Information without your consent in a manner materially different from what was stated at the time it was collected.

Governing Laws; Jurisdiction; Commencement of Actions
This privacy policy and the interpretation of this privacy policy will be governed by and construed under the laws of the state of Michigan, without regard to its conflicts of laws principles, and will specifically not be governed by the United Nations conventions on contracts for the international sale of goods, if otherwise applicable. By using the site, you agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to the site, the use or access thereof, or this privacy policy shall be in the applicable state or federal courts located in Ann Arbor, MI. You hereby consent and submit to the exclusive personal jurisdiction and venue of the applicable federal and state courts located in Ann Arbor, MI for any such legal proceeding. You agree that any cause of action or claim you may have with respect to the site must be commenced within one year after such claim or cause of action arises or else you agree you have waived any such claim.

Covid Policy

These updated COVID policies are implemented by Jewel Heart because providing a safe environment for in-person attendance is our top priority.

As virus infections are now hovering in the lower ranges, masking is no longer required. We do ask that, for the benefit of others, if you are feeling ill or have any type of contagious cold or virus or other infection that you please remain home. If COVID or Flu conditions in the area are reported to be elevated to “medium” or above, we may institute a masking requirement at that time.

People who are infected but asymptomatic or people with mild COVID-19 should isolate through at least day 5 (Day 0 is the day symptoms appeared or the date the specimen was collected for the positive test for people who are asymptomatic). They should wear a mask through day 10. A test-based strategy may be used to remove a mask sooner. If your symptoms were moderate to severe, isolate through day 10. If your illness was severe you may need to consult a doctor before ending isolation.

Jewel Heart’s Full Discretion:
I understand Jewel Heart also reserves the right to ask anyone not following these policies and procedures to leave immediately and I agree to this.

Assumption of Risk:
I understand Jewel Heart is relying on the good faith of attendees regarding the confirmations/certifications noted above and I assume all risk of getting sick with Covid-19 or variants and the ramifications, up to and possibly death, in attending Jewel Heart programs onsite. I am attending the Program voluntarily, fully aware of and at my own risk.

Jewel Heart Policy on Prohibition of Harassment (including Sexual Harassment) or Discriminatory Conduct during Jewel Heart Events

Jewel Heart is committed to establishing and maintaining an environment that fosters harmonious sangha and community relations and encourages mutual respect. Accordingly, Jewel Heart is unequivocally opposed to, and will not tolerate, any harassment of a sexual, racial, ethnic or religious nature protected by US federal law (such as race, color, religion, national origin, age, disability) that is directed toward any person attending any Jewel Heart event, whether on Jewel Heart premises or at an event sponsored by Jewel Heart.

Harassment includes, but is not limited to, verbal harassment, physical harassment, visual harassment and innuendo. Sexual harassment is a violation of Jewel Heart policy as well as common law and/or statutory law in the US. Sexual harassment is considered to be constituted by unwelcome sexual advances, requests for sexual favors, sexually motivated physical contact and other verbal or physical conduct, or visual forms of harassment of a sexual nature. Sexual harassment is a general term and includes more than overt physical or verbal intimidation.
Any member of the Jewel Heart Community who is found to have engaged in conduct constituting harassment when attending a Jewel Heart event will be subject to appropriate action including being asked to leave the premises.

This policy only applies to Jewel Heart events, whether on Jewel Heart premises or at a Jewel Heart event, including a Zoom event. The policy does not apply to activities outside Jewel Heart events, including private behavior between individuals that met or are in some way connected to Jewel Heart.

Complaint Procedure: Discrimination and Harassment

Any person attending any Jewel Heart event who feels that he or she has been harassed or discriminated against should contact Debbie Burr, Director of Administration and Operations, and report the relevant facts immediately unless this person is involved or you feel uncomfortable, in which case report the matter to the Co-Executive Directors. Management contacted will bring the complaint to the attention of those who need to know to handle the complaint. Jewel Heart officers or management must be aware of a discrimination or harassment problem in order to provide for a remedy. Jewel Heart puts a great deal of importance on seeing that such behavior is not permitted to persist.

Charges of harassment and discrimination will be promptly investigated. Confidentiality will be maintained on a “need to know basis” throughout the investigatory process, in light of the important privacy interests of all concerned. However, Jewel Heart reserves the right to disclose information and take any appropriate remedial and disciplinary action in order to discharge its legal obligations.

If Jewel Heart determines that harassment or discrimination has occurred, appropriate relief for the person bringing the complaint will follow, including the harasser(s) or discriminating person(s) being subject to appropriate action, including being asked to leave the premises.

No person bringing a complaint will be retaliated against for the good-faith exercise of rights under this policy (regardless of the outcome).
